1. Agreement to Terms

2. Insurance Policy Terms

All home insurance policies are subject to the specific terms, conditions, exclusions, and limitations outlined in your policy documents. These Terms and Conditions supplement, but do not replace, your insurance policy terms.

2.1 Policy Eligibility

  • You must be at least 18 years of age to purchase a policy
  • The property must be your primary or secondary residence
  • Property must meet our underwriting guidelines
  • Accurate information must be provided during the application process

2.2 Coverage Limits

Coverage limits and deductibles are specified in your policy documents. You are responsible for understanding your coverage limits and ensuring they adequately protect your property and assets.

3. Premium Payments

Premiums are due according to the payment schedule specified in your policy. Failure to make timely payments may result in policy cancellation.

  • Payments can be made monthly, quarterly, or annually
  • A grace period of 30 days is provided for late payments
  • Late payment fees may apply
  • Policy lapses after the grace period if payment is not received

4. Claims Process

In the event of a covered loss, you must notify WamuIns as soon as reasonably possible. Our 24/7 emergency hotline is available for immediate assistance.

4.1 Claim Filing Requirements

  • Provide prompt notice of loss
  • Submit all required documentation
  • Cooperate with our investigation
  • Take reasonable steps to prevent further damage
  • Provide access to the property for inspection

4.2 Claim Processing

We strive to process claims within 48 hours of receiving complete documentation. Complex claims may require additional time for thorough investigation.

5. Policy Cancellation

Either party may cancel the insurance policy subject to the terms specified in your policy documents.

5.1 Cancellation by You

You may cancel your policy at any time by providing written notice. You may be entitled to a pro-rata refund of unearned premium, subject to applicable fees and state regulations.

5.2 Cancellation by WamuIns

We may cancel your policy for reasons including, but not limited to, non-payment of premium, material misrepresentation, or substantial increase in risk. We will provide advance notice as required by state law.

6. User Obligations

As a policyholder, you agree to:

  • Provide accurate and complete information
  • Maintain the property in good condition
  • Notify us of any material changes to the property or occupancy
  • Comply with all policy terms and conditions
  • Allow property inspections as needed

7. Website and Digital Services

Our website and mobile applications are provided for your convenience. We reserve the right to modify, suspend, or discontinue any aspect of our digital services at any time.

7.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

8. Limitation of Liability

To the fullest extent permitted by law, WamuIns shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services.

9. Dispute Resolution

Any disputes arising from these Terms and Conditions or your insurance policy shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

10. Privacy and Data Protection

11. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Material changes will be communicated to policyholders via email or through our website. Continued use of our services constitutes acceptance of the modified terms.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions.
